These Terms and Conditions describe the ordering service online product range available at our shop CHICKEN & PIZZA and accessible via the website www.chickenpizzamonaco.com
These General Terms and Conditions (hereinafter "GTC") apply to all orders (hereinafter "Order") of one or more products (hereinafter or "Product (s)") passed by the purchaser (hereinafter "Customer") on the merchant site www.chickenpizzamonaco.com (hereinafter the "Site"), published by SCS ROCHER & Co. (hereinafter "Publisher") from our shop CHICKEN & PIZZA (hereinafter the "Vendor).

The online ordering on the site is reserved for customers aged 13 years old at the date of placing the order.
Seller reserves the right to change the Terms at any time. In all cases, the applicable terms and conditions will be those on the Website on the date of the Order by the Customer.

Definitions


In these Conditions, the following words or phrases have the following meanings:
- The term "Seller" and "Store" means the company operating the store under the name CHICKEN & PIZZA selected by the Client and to which the order will be registered and whose details will be indicated on email confirming the order and the receipt issued by CHICKEN & PIZZA upon delivery of the Products.
- The term "ORDER" means the service provided by the Editor, and the entire ordering process online products available in our shop. The customer makes the payment of his order online.

 

1. Acceptance of Terms


The Customer declares to have read and accepted these Terms and Conditions before placing his order. Any Order of a Product on the Site therefore materializes from the Client's express acceptance of these Terms.

 2. Products


The products offered by our shop selected by the Customer are those listed in the catalog published on the site on the day of the order, if in stock.
The products offered for sale may be modified or deleted by the Seller without prior notice. The photographs and illustrations submitted online are not contractual.

3. Create an account


To order, Customer must create an account which will allow access to past orders. When registering, the customer chooses a username and password which associates its name / first name, date of birth, street address (house number, floor, door code) and a working phone number to allow the delivery staff from CHICKEN&PIZZA to deliver the order in the best conditions and deadlines.
It is the customer's responsibility to keep his username and password strictly confidential and to not disclose them to third parties, to avoid the risk of intrusion of the Customer's account and placing orders without his knowledge by unauthorized persons. The Seller cannot be held responsible for any unauthorized person hacking into the Customers account.

4. Execution of Orders

Accept Terms,
Make online payments of order.

5. Proof of the Order


The final validation of the Order will be considered proof of the entirety of the said Order and validates the sum of the order.
The records of Seller, kept in the computer systems of the Seller or his back office provider, within reasonable security conditions, will be considered by the Seller and the Customer as proof of communications, orders, payments and transactions between the parts.

6. Cancellation and modification of an Order


According to the provisions of Article L121-20-2 3 of the Consumer Code, the withdrawal applicable law on distance selling may be exercised in the case of the supply of goods which because of their nature liable to deteriorate or expire rapidly.
Pursuant to this text, it is expressly stated that any order on the Site are final and that exercising the right of withdrawal is excluded.
The validated Orders can therefore not be canceled. No goods can be returned or exchanged.

7. Product Delivery


Online ordering service schedules are available on the website during business hours.

Once the order is confirmed, delivery usually occurs within thirty to ninety minutes, subject to variations due to a high number of orders and subject to a case of force majeure as defined by law . Any delays are mentioned for information only and is not contractual.

8. Complaints


Any question relating to the delivered products must be made within a maximum period of twenty-four (24) hours after the delivery of the products, from the Seller, by mail to the address on the receipt and on the confirmation email sent on the Order. After this time, no questions and no claim will be considered.

9. Prices

The prices on the Online Order are TTC (all taxes included) in euros taking into account the VAT applicable on the date of the Order.
Seller reserves the right to change prices at any time, except the prices contained in the catalog the day of the order shall be applicable only.

10. Payment of the Order

The credit card payments are made through a reliable and secure payment system which guarantees the preservation of the confidentiality of credit card numbers by procedures of protection and cryptology.

11. Liability

The Customer is informed that the Editor can rely on the skills of a particular external provider to manage its entire back office and payment secure online order. The Customer undertakes to never seek the responsibility of the Publisher and act directly with the service provider in case of dispute arising in particular during the use of the secure payment module. The Editor will make every effort to ensure that the email address at which contact the provider is available and easily accessible.

12. Protection of personal data


Personal data collected on the Site are required to process the order and will be communicated to partners of the Mandates on express acceptance of the Customer. Pursuant to Article 13 of the 1165 Act of 23 December 1993 amended, you have a right to access and rectify data concerning you, the customer may object to the disclosure of such data to a third party. The exercise of these rights is to be made to: SCS ROCHER et Cie with proof of your identity (a photocopy of identity).

 13. Minors


Pursuant to the Sovereign Order 2533 of 10.15.1941 art. 8 and Art.13, the sale of alcohol to minors under eighteen (18) years is prohibited. Therefore, the purchase of any alcohol-based product in the Order, is strictly forbidden to minors under eighteen (18) years. On this occasion, an ID may be requested to the Customer upon delivery of his order.

14. Indivisibility


The invalidity of any provision of this Agreement pursuant to such a law, regulation or following a court decision will not result in the invalidity of these GTC.

15. Dispute Resolution


These Terms are subject to Monegasque law. In case of dispute, the customer should first contact the Seller in order to find an amicable solution. Otherwise, jurisdiction is given to the court of Monaco.
